Our local coupons terms and conditions

These terms apply to all advertising provided to any person (‘Customer’) by our local coupons Pty Ltd ABN 69 152 202 661, ACN 152 202 661 or a subsidiary (OLC). Customer includes an advertiser on whose behalf Advertising is placed and any media company or agency that arranges the Advertising for its clients.

Rectification

• A Retailer/vendor is any person/business who offers discounts, specials or bonuses on goods or services to Customers by way of Coupons;
• Our local Coupons and Retailers are independent parties and are not partners, joint ventures or principal and agent;
• our local Coupons acts solely in the capacity of an introducer and In no circumstances will our local coupons or its related bodies corporate or its directors or members of staff be liable to a Customer for any direct, indirect, incidental, special and/or consequential losses or damages or loss of profits or loss of revenue or loss of business opportunity of whatever nature howsoever arising from or relating to any material or information displayed in a our local coupons booklets or from the conduct of any Retailer or distributor of the OLC Booklets;
• By having a coupon on our local Coupons you are providing a product or service to customers You are making an offer to the consumers that they may redeem the coupon within the start date and expiry date;
• OLC will not be liable for any delay or failure to publish Advertising caused by a factor outside OLC reasonable control.

Coupons campaign

Subject to these Terms, our local coupons will use its reasonable Endeavour’s to publish advertising (‘coupons) in the format and in the position agreed with the Customer. ‘Advertising’ includes images submitted for publication and content or information relating to published Advertisements.
Customer grants our local coupons a nationwide and worldwide, royalty-free, non-exclusive, irrevocable license to publish, and to sub-license the publication of, the Advertising in any form or medium, including print, online or other.

Right to Refuse Advertising

Neither these Terms nor any written or verbal quotation by our local coupons Pty Ltd represents an agreement to publish Advertising. An agreement will only be formed between our local coupons and Customer when OLC accepts the Advertising in writing or generates a tax invoice for that Advertising.
Our local coupons reserve the right to refuse or withdraw from publication any Advertising at any time without giving reasons (even if the Advertising has previously been published by OLC.
This site contains links to other websites. Our local coupons are not responsible for the privacy practices or the content of such websites
OLC will not be liable for any loss or damage incurred by a Customer arising from our local coupon’s failure to publish Advertising in accordance with a Customer’s request. .
Customer warrants to OLC that the publication of the Advertising does not breach or infringe:

•  any copyright, trade mark, obligation of confidentiality or other personal or proprietary right;
•  any law of defamation, obscenity or contempt of any court, tribunal or royal commission;
•  Any other law or applicable code (including any common law, statute, delegated legislation, rule or ordinance of the Commonwealth, or a State or Territory).

Advertising containing contact details for the Customer must contain the full name and street address of the Customer. Post office box and email addresses alone are insufficient.
  
Online banner  

All online banners and advertisement must comply with OLC advertising specifications. OLC will measure online display and banner Advertising. OLC is not liable for loss or damage from an internet or telecommunications failure

Payment

• We may require you to pay a deposit to us as security for fulfillment of your payment obligations in respect for your coupon campaign. Deposit is non-refundable.
• The Customer must pay for Advertising, at the agreed rate. Rate is based on agreement between OLC and customers. Rates may be varied at any time by our local coupons without notice. Customer must pay GST at the time it pays for Advertising. OLC will provide a tax invoice or adjustment note (as applicable).
• The Customer must pre-pay for Advertising if required by OLC. If Advertising is on account, payment must be within 7 days of date of the invoice or, if a commercial account has been established with OLC, payment must be within 14 days of invoice date.
• Customer must pay the full price for Advertising even if OLC varied the format or placement of the Advertising or if there is an error in the Advertising, unless the error was OLC’s fault. Customer must pay the transmission costs.

 Failure to Pay and Other Breach:

• If Customer breaches these terms and fails to pay for Advertising or suffers an Insolvency Event, OLC may (in its discretion and without limitation):
• Cancel any provision of credit to Customer;
• Require cash pre-payment for further Advertising;
• Take proceedings against the Customer for any outstanding amounts;
• Recover OLC’s costs including mercantile agency and legal costs on a full indemnity basis;
• Cease publication of further Advertising or terminate an agreement for Advertising not published;
• Exercise any other rights at law.

Art work

Our local coupons retain the copy writes of all designs and texts prepared by its employees. Any unauthorized copying, editing or reproductions of any art work in any form without written permission my result in legal proceedings.

Coupons terms of use  

Coupons are not for sale and not redeemable for cash, offers not receptive for change, conditions stipulated on coupons must be abided by accordingly. Should any participating corporation conclude trade, due to any reason beyond our control, the coupon for that establishment will be considered void. Limit of one coupon per person, a coupon may not be used in conjunction with another offer, If a coupon is used and your entire order is cancelled or rejected, or if you return all items in your order, you will be refunded the actual amount paid and your coupon will no longer be valid. Our local coupons reserve the right to discontinue a coupon at any time. our local Coupons acts solely in the capacity of introducer and is not responsible for and disclaims liability for all acts and/or omissions of Retailers and/or any defects or damage, injury or loss caused by a Retailer’s goods or services.

Privacy

These Terms, with any other written agreement, represent the entire agreement of the Customer and OLC for Advertising. They can only be varied in writing by an authorized officer of OLC. No purchase order or other document issued by the Customer will vary these Terms

Upon agreeing to these Terms and Conditions, the Vendor gives our local coupons permission to publish their business name, address and phone number and business information on the displayed coupon.
